The Council of the EU adopted Regulation No 2368/2002 (hereinafter referred to as: the Regulation) with the view to make controls over the international trade in rough diamonds more effective. The Regulation establishes a system of control over the trade in rough diamonds in the EU in order to maintain international peace and security and to protect the revenue form exports of rough diamonds, which is essential for the development of producer countries.

The Kimberley Process certification scheme means that the participants in the Kimberley Process certification scheme (KP) are obliged to assure compliance of every shipment of rough diamonds which is imported into or exported from the participant in the KP certification scheme with the conditions and requirements of the Regulation laid down for import into, export from and transit through the EU. The Regulation comprises the following annexes: Kimberley Process certification scheme (Annex I), List of participants in the Kimberley Process certification scheme (Annex II) and List of Member States’ competent authorities and their tasks (Annex III).

Trading with non-participants in the KP certification scheme is not permitted.
