Organic farming is a part of a wider supply chain which, apart from agricultural production, also includes processing, delivery and sale of foodstuffs. Agricultural products or foodstuffs may be labelled as “organic” only on condition that a certificate of inspection for import of products from organic production into the European Union (hereinafter referred to as: certificate of inspection) has been issued in electronic Trade Control and Expert System (TRACES) for such products. It certifies that the products comply with the conditions set out for the production and processing of organic products and that the producers or processors are registered as producers or processors of organic agricultural products or foodstuffs.
Organic products and foodstuffs imported from third countries must be accompanied by documentary evidence laid down in Commission Regulation (EC) No 1235/2008 proving that products and foodstuffs have been produced and processed according to the rules and their traceability at all stages from the primary producer up to the final consumer can be ensured.
Customs authorities perform controls of imports of organic products and foodstuffs and release them into free circulation. They check the conformity of the consignment with the accompanying documents and, if necessary, perform a physical control of the consignment. When released for free circulation the consignment of organic products and foodstuffs must be accompanied by an original certificate of inspection. The original certificate of inspection shall be a printed and hand-signed copy of the completed electronic certificate in TRACES or, alternatively, a certificate of inspection signed in TRACES with an advanced electronic signature. The copy of the certificate of inspection is endorsed by the customs authorities. Where a consignment of organic products is split into different batches before its release for free circulation, customs authorities must check the original copy of the certificate of inspection and endorse it. For each of the batches which results from the splitting, an extract of the certificate of inspection must be submitted (from the TRACES). The extract is then endorsed by the customs authorities which releases the batch for free circulation. If a consignment of organic products and foodstuffs is not accompanied by an original copy of the certificate of inspection, or if irregularities are established in the consignment or the documents, customs authorities contact the locally competent office of the Administration of the Republic of Slovenia for Food Safety, Veterinary and Plant Protection to act in compliance with their powers.
